THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7155 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/A2 & A4 seeking bail in the event of their arrest in connection with Crime No.45 of 2022 on the file of Ganneruvaram Police Station, Karimnagar District, registered for the offences punishable under Sections 447, 324, 323, 506 read with 34 of Indian Penal Code.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case of the prosecution is that on 16.07.2022 while the defacto complainant and others were cultivating their lands, it is alleged that Accused Nos.1 to 4 trespassed into the said land and picked up a quarrel. Thereafter, Accused No.1 beat with an Axe on the head of the victim, Accused No.2 beat the victim with a stick causing injuries and Accused Nos.3 and 4 caught hold the hair of the victim and drown her a little bit into the water. Thereafter, when the neighbouring persons rushed to rescue the victim, all the accused fled from the place. 4.

As seen from the Remand report, the allegation against these petitioners is that petitioner No.1/A2 beat the victim with a stick and petitioner No.2/A4 along with her mother (A3) caught hold the hair of

the victim and drown her a little bit into the water. The petitioners are students aged 21 and 19 years, respectively. It appears to be a case of dispute regarding land. In the said circumstances, the petitioners/A2 & A4 shall be enlarged on bail in the event of their arrest, subject to the following conditions:

1) The petitioners/A2 & A4 are directed to surrender before the Station House Officer, Ganneruvaram, Karimnagar district, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/A2 & A4 on bail, on their executing personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/A2 & A4 shall appear before the concerned Station House Officer as and when required, for the purpose of investigation.

3) The petitioners/A2 & A4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
