ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioner/accused seeking to quash the proceedings in Cr.No.20 of 2016 of Godavarikhani I Town Police Station, Karimnagar District, registered for the offences punishable under Sections 420 and 506 IPC, against him.
2. It is alleged in the complaint that the accused is the cobrother of the complainant and out of said relationship, the accused borrowed a sum of Rs.10 lakhs from the complainant and issued a cehque on 29.04.2013. When the said cheque was presented in the Bank, the same was dishonored due to insufficient funds, thereupon, the complainant issued a legal notice to the accused. Even though the accused promised to pay the amount in the month of December, 2015 from out of his retirement benefits, he did not pay the same and he also threatened the complainant with dire consequences. Based on the complaint, the aforesaid crime was registered against the petitioner/accused.
3. On a private complaint filed by the complainant, the matter was referred to the police u/s.156(3) Cr.P.C. for investigation. Since there are some allegations against the accused in the complaint, this Court is not inclined to interfere with the impugned proceedings. However, the concerned police are directed to complete the investigation without arresting the petitioner/accused and file a final report, if any.
4. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
