THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.12482 of 2013 ORDER:
Heard learned counsel for the petitioner as well as learned Government Pleader appearing for respondent Nos.1 to 3. 2.
The prayer sought in the writ petition is as under:- "...to issue a writ, order or direction and more particularly one in the nature of Writ of Mandamus directing the 3rd Respondent to investigate the case in FIR No.378 of 2008 and take further action in the matter." 3.
Learned Government Pleader brought to the notice of this Court that pursuant to registration of Crime No.378 of 2008, investigation was taken up and after completion of investigation, a final report was filed on 05.04.2009 before the learned Judicial Magistrate of First Class at Siricilla referring the matter as 'mistake of fact'. A copy of the said final report was also served on the petitioner/complainant. 4.
If that be so, the remedy available to the petitioner, if he is not satisfied with the final report, is to file a protest application raising the objections.

In these circumstances, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.

Accordingly, the writ petition is closed.
Miscellaneous petitions pending, if any, shall stand closed. No costs.
