2) The brief facts in Crime No.195/2010 registered by Inspector of Police, Rein Bazar P.S are thus: a) On 03.10.2010, Mohd. Khizer-Respondent No.1 in 'A' party along with President of Masjid-e-Ibrahim Khaleelullah & Welfare Society came to police station and gave report stating that he belongs to Ahah-e-Hadis sect of Islam and about 4 months ago, he purchased 106 sq.yards of site in Madina Nagar from Smt. Mahaboob Bee and about 8 days back he constructed a shed with the help of Ibrahim Khaleelullah Welfare Charitable Society to offer prayers and accordingly they are offering prayers with his community people everyday. While-so, on 03.10.2010 morning at about 4:45 am, when he came to Masjid for Azan, he found smoke emitting from the mosque, on opening the lock he found carpets, cartons and some holy books were burnt.

Basing on the said report, a case in Crime No.194/2010 was registered as fire accident. b) During the course of investigation, majority of residents of Madina Nagar, Talab Katta and Sri Mohd. Afzal, the president of Madina Nagar Educational Welfare Society belonging to Sunnat-ul-Jamath submitted several representations raising strong objections for construction of mosque at the premises No.17-3-193/35 in Madina Nagar by the complainant-Mohd.

Khizer on the ground that he was a non-local and belonging to Ahal-e-Hadees, sect of Islam community and the residents of Madina Nagar already have a big mosque in their locality which is sufficient enough for offering prayers on all occasions and if the Masjid is established by the complainant at the said premises, it will become a place for terrorism, communalism and there will be breach of peace in future. In the said representation, the residents of Madina Nagar requested to take steps to see that mosque was not constructed so as to prevent law and order problem in the locality. c) While-so, the complainant again went to the Police Station on 03.10.

2010 at about 17:00 hours and submitted a petition that the assets of Masjid were burnt by some unknown local people on the intervening night of 2/3-10-2010 and requested to take necessary legal action. Basing on the said petition, the section of law was altered from Fire Accident to 436 IPC and investigated into. d) The Inspector further mentioned that during the course of investigation, he came to know that the residents of Madina Nagar have strong objection in regard to the constructions of Masjid in their locality by non-locals and in that regard some pamphlets were distributed against the constructions of mosque, he came to know that no permission was obtained from the authorities by raising the shed by the complainant in Crime No.194/2010.

Finally, the Inspector mentioned that tension was prevailing in the area and police picket was posted to prevent law and order problem. Hence he registered a case in Crime No.195/2010 under Sec.133 Cr.P.C and requested the Special Executive Magistrate-cum-Revenue Divisional Officer, Hyderabad to pass necessary orders. Hence the instant petition by some of the respondents in 'B' party. 3) Opposing the proceedings in Mc.No.B/490/2010, learned counsel for petitioners submitted that since more than 5 years the petitioners have been regularly attending the Court but the prosecution has not filed any kind of evidence or record to establish the case under Sec.133 Cr.P.C and the continuation of proceedings causes any amount of hardship to the petitioners.

He also argued that the 'A' party members have no legal right to make any constructions in the Madina Nagar locality since they have not obtained any permission from the authorities. He thus prayed to allow the petition and quash the proceedings in the interest of justice. 4) Strongly opposing the petition, learned Additional Public Prosecutor argued that since the tension prevailed from 03.10.2010, the Police had to setup Picket in the Madina Nagar area to prevent breach of peace and tranquility and later Crime No.195/2010 was registered under Sec.133 Cr.P.C and now the matter is pending enquiry before the Special Executive Magistrate-cum-Revenue Divisional Officer, Hyderabad and both parties submitted their counter affidavits and recently matter was posted for arguments on 29.11.

2014 and in view of the background facts of the case and present stage of the matter, the petition may be dismissed. 5) In the light of above rival arguments, the point for determination is: "Whether there are merits in this petition to allow?" 6) POINT: From the facts narrated in FIR No.195/2010, it emerges that due to a sensitive issue of construction of another mosque in Madina Nagar against the protests of the residents of that locality, law and order problem has erupted which led Police to setup picket and also to register the instant FIR under Sec.133 Cr.P.C. Having regard to these background facts, it is not apposite to quash the proceedings in the interest of justice.

However, considering the submission of learned counsel for petitioners that the petitioners have been attending before the Special Executive Magistrate-cum-Revenue Divisional Officer, Hyderabad since last five years in the proceedings under Sec.133 Cr.P.C which causes any amount of hardship to them, a suitable direction can be given to the learned Special Executive Magistrate to dispose of the matter expeditiously. 7) In the result, this Criminal Petition is dismissed with a direction to the learned Special Executive Magistrate-cum-Revenue Divisional Officer, Hyderabad to complete the enquiry in MC.No.B/490/2010 expeditiously and pass appropriate orders as per law within four(4) months from the date of receipt of copy of this order.
