THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE MS JUSTICE J.UMA DEVI Writ Petition No.25544 of 2017 ORDER: (Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan) Heard Sri G.Venkata Krishnaiah, learned counsel for the petitioner, the learned Government Pleader for Services (AP) and the learned Government Pleader for Services (TG) and, with their consent, the writ petition is disposed of at the stage of admission. The petitioner's only grievance in this writ petition is that, though he was working as an Assistant Sub-Inspector of Police, he has been finally allocated to the State of Andhra Pradesh as a Head Constable and not as an Assistant Sub-Inspector of Police. His grievance is not with regards his final allocation to the State of Andhra Pradesh, but to his being allocated to the said State not as an Assistant Sub-Inspector of Police but as a Head Constable.
The learned Government Pleader for Services (TG) would point out, in our opinion rightly so, that the final allocation of the employees, between both the States of Telangana and Andhra Pradesh, is required to be made with reference to the appointed day i.e 02.06.2014; and, as the petitioner was a Head Constable as on that day, and was promoted subsequently on 01.11.2014 as an Assistant Sub-Inspector of Police, his final allocation to the State of Andhra Pradesh can only be as a Head Constable.
Since the petitioner was working as a Head Constable on the appointed day i.e 02.06.2014, he was rightly allocated finally to the State of Andhra Pradesh as a Head Constable. The petitioner's subsequent promotion as an Assistant Sub-Inspector of Police on 01.11.2014 shall be considered by the Government of Andhra Pradesh while issuing posting orders to him in the State of A.P.
The Writ Petition is disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
