HONOURABLE JUSTICE G. SRI DEVI Criminal Revision Case No.1284 of 2019 ORDER:

This revision is filed under Section 397 read with Section 401 Cr.P.C., by the petitioner/owner of vehicle, aggrieved by the order dated 30.09.2019 passed in Crl.M.P.No.2471 of 2019 in Cr.No.369 of 2019 by the learned XI Additional Chief Metropolitan Magistrate, Secunderabad.

By the order impugned, the learned Magistrate directed to return the property i.e., Honda Activa 3 G bearing No.TS 09 EV 9668, to the petitioner for interim custody, on her executing a personal bond for a sum of Rs.80,000/- with one surety for the like sum.

Learned counsel for the petitioner contended that as the petitioner is a house wife, she is unable to furnish such huge amount of personal bond and surety and therefore, he seeks to modify the said order by reducing the said amount.

The petitioner is owner of the subject vehicle and if the vehicle is kept idle for a long period, there is every possibility of it getting damaged. Therefore, ends of justice would be met, if the amount of personal bond and surety is reduced from Rs.80,000/- to Rs.40,000/-.

Accordingly, the Criminal Revision Case is disposed of, with a direction to the petitioner/owner of vehicle to furnish a personal bond

for a sum of Rs.40,000/- (Rupees forty thousand only) with one surety for a like sum to the satisfaction of the concerned Court. 6.

Miscellaneous applications, if any pending in this revision, shall stand closed.
