THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.8215 OF 2001 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the proceedings of the 3rd respondent, dated 20.11.2000 and consequential proceedings of the 1st respondent, dated 21.12.2000, as illegal and arbitrary and consequently, to direct the respondents to pay the salaries to the petitioners in the time scale as mentioned by the Management in the appointment orders.

Heard Smt. K. Kiran Mayee, Counsel representing Sri Mahadev Kanthrigala, learned Counsel for the petitioners and the learned Assistant Government Pleader for School Education.

It has been submitted by the learned Counsel for the petitioners that the petitioners were appointed as B.Ed Assistant and Telugu Pandit Grade II respectively in the 4th respondent-institution during the year 1998 and while they were working as such, the State Government issued G.O.Ms.No.180, dated 29.12.2000 admitting the petitioners' posts into grant-in-aid, and after admitting the posts held by the petitioners into grant- in-aid, the official respondents had been paying consolidated wages instead of extending the time scale, and questioning the same, the present writ petition is filed. It has been further submitted by the learned Counsel for the petitioners that the issue raised in this writ petition is squarely covered by the judgment of this Court in W.A.No.373 of 2006 dated 13.11.2014, and therefore, this writ petition be allowed in terms of the judgment in W.A.No.373 of 2006, dated 13.11.2014.

The learned Assistant Government Pleader appearing for the respondents contends that the issue raised in this writ petition is squarely covered by the judgment of this Court in W.A.No.373 of 2006, dated 13.11.2014.

In view of the above submissions, the Writ Petition is disposed of in terms of the judgment of this Court dated 13.11.2014 in W.A.No.373 of 2006, with a direction that the petitioners be paid the salaries in the time scale attached to the post of B.Ed assistant and Telugu Pandit Grade II from the date on which their posts were admitted into grant-in-aid. However, with no costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
