THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3592 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in FIR No.57 of 2016 on the file of the Gachibowli Police Station, Cyberabad, Ranga Reddy District, registered for the offence punishable under Sections 419, 468, 420 and 471 r/w 34 IPC.

Heard and perused the material available on record. It is alleged that the 2nd respondent-de facto complainant had purchased the plot No.745-B Block, Survey No.202 situated at Sree Ramnagar Colony in the year 1989 and since then, she is in possession of the same. When her daughter took encumbrance certificate, it came to light that the above said property stood in the name of the petitioner. She obtained the copy of the alleged document and came to know that petitioner and another lady impersonated and created documents and got registered the above property in the name of the petitioner for their illegal gain.

It is the case of the petitioner that he is a genuine purchaser and he is not aware as to whether his vendor was original or not and therefore, no criminal liability can be fastened on him. Considering the facts and circumstances of the case, the petitioner is directed to surrender before the Station House Officer concerned. On such surrender, the Station House Officer concerned is directed to release the petitioner on bail on his executing personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum to the satisfaction of the Station House Officer concerned. The petitioner is directed to appear before the S.H.O concerned as and when required. He is further directed to identify a person, who sold the property to him, and furnish the details to the S.H.O concerned.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________________ JUSTICE RAJA ELANGO Date : 17.3.2016 Nn
