HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY CONTEMPT CASE No.1110 of 2015 Date:14.8.2015 Between:

Bandi Subbarayudu, S/o Pedakondaiah ..... Petitioner And:

M.Lakshmi Narasimha Rao, Revenue Divisional Officer, SPSR Nellore District and two others.

.....Respondents Counsel for the Petitioner: Sri P.Sreenivasulu Counsel for the Respondents: GP for Civil Supplies (AP) The Court made the following:

ORDER:

This Contempt Case is filed alleging willful disobedience of interim order, dated 29.10.2014, passed in Writ Petition No.32321 of 2014.

Respondent No.1 has passed a final order against the petitioner in respect of his dealership despite the unequivocal interim order granted by this Court on 29.10.2014 in Writ Petition No.32321 of 2014 suspending the order of termination passed by him. When this misdemeanour on his part is caught, he has offered a lame excuse of incorrect understanding of the order of this Court, which is otherwise clear, unequivocal and free from any ambiguity, and has withdrawn the order passed

by him.

While the main Writ Petition is pending, the respondents have again inspected the petitioner's fair price shop and passed an order suspending his authorization.

However, in the counter-affidavit, respondent No.1 has stated that even that order has been cancelled and the petitioner's fair price shop authorization has been restored in all respects. Though I find the acts of respondent No.1 wholly contemptuous, in view of the remedial steps taken by him evidently due to the filing of the Contempt Case, I am closing the Contempt Case however with a serious warning to respondent Nos.1 and 2 not to repeat this conduct in future.
