THE HON'BL SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.10610 of 2016 O R D E R:

Heard the learned counsel for the petitioner and the learned Government Pleader for the Panchayat Raj Department. The prayer in the writ petition is as under:

"It is therefore prayed that this Hon'ble court may be pleased to issue a writ order or direction especially one in the nature of Writ of Mandamus declaring that a) The action of the respondents in not making payment to the petitioner for the work executed and bills submitted in respect of the work executed by the petitioner, for construction of two additional classrooms to Government Junior College, Malkajgiri, Ranga Reddy District, under special development fund scheme is illegal and arbitrary and in violation of article 16 and 300-A of the Constitution of India.

b) and further declare that petitioner is entitled for payment of admitted bill amount without reference to the Memo No.13/Plg.IX/SDF/2014,dt:25.06.2014.

c) declare that petitioner is entitled for release of balance amount in pursuance of recommendations of the Executive Engineer PRI Division, Hyderabad, R.R District, in his letter dated 26.03.2015 and 06.10.2015.

d) and pass such order or orders as this Hon'ble Court may deemed fit and proper in the circumstances of the case.

When the matter is taken up for hearing today, learned counsel appearing for the petitioner would submit that the entire amount has been paid to the petitioner, and, therefore, no further cause would survive in the writ petition.

Therefore, the Writ Petition is closed.

Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed. No order as to costs.
