HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Civil Revision Petition No. 3663 of 2015 Order:

The defendants in OS No.191 of 2014 on the file of VI Additional District and Sessions Judge, Kakinada, East Godavari District, are the petitioners herein. An ex parte decree was passed on 28.02.2015 in the said suit for eviction. The respondent filed EP No.34 of 2015 for eviction and the same was ordered. At that stage, IA No.697 of 2015 was filed seeking stay of eviction proceedings in EP No.34 of 2015 along with IA No.698 of 2015 seeking condonation of delay of 183 days in filing the petition to set aside the ex parte decree, dated 28.02.2015.

2. Since no order is passed and the present CRP is filed without challenging any order, this Court is not inclined to entertain the present CRP, however, directs the learned III Additional District Judge, Kakinada, before whom IA Nos.697 of 2015 and 698 of 2015 are pending, to consider the same and dispose of in accordance with law.

3. With the above observation, the CRP is dismissed. There shall be no order as to costs.

4. As a sequel thereto, the miscellaneous petitions, if any, pending in the Civil Revision Petition shall stand closed. ________________________ A.
