HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 8509 OF 2021 O R D E R:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner - Accused No. 1 seeking bail in the event of his arrest in connection with Crime No. 1079 of 2021 of P.S. Gachibowli registered for the offences punishable under Sections 306 read with Section 498-A IPC.

The case of prosecution is that on 10.10.2021 at 12.00 hours, the de facto complainant Sri Nalla Mahipal lodged a Teluguwritten complaint stating that on 10.10.2021 at about 04.30 hours, he received a phone call from his brother Kunta Bojanna stating that his (complainant's) daughter Yenugu Anusha (deceased) posted suicide photos on whats app status and he immediately rushed to TNGO's Colony where apartment watchman informed that his daughter committed suicide and he suspects his son-in-law i.e. petitioner and his parents and sister responsible for the said incident.

Learned counsel for petitioner Sri C. Naresh Reddy submits that before committing suicide, the deceased posted video in whats app, but she has not stated anything against petitioner and in fact, she wanted their children to be taken care of by petitioner. The learned counsel placed on record the contents of the video by way of a memo before this Court. 4.

On the other hand, learned Assistant Public Prosecutor does not dispute the said fact.

Taking into consideration the contents of the video, this Court deems it appropriate to grant pre-arrest bail to petitioner.

Accordingly, this Criminal Petition is allowed and petitioner - Accused No. 1 shall be released on bail in the event of his arrest in connection with Crime No. 1079 of 2021 of P.S. Gachibowli on his executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the Station House Officer, Gachibowli Police Station.
