O R D E R
As the deficiencies pointed by the Expert Visiting Committee have not been complied with, vide orders dated 07.12.2017 of the 1st respondent, the Engineering College run by the petitioner - Society was placed under 'No Admission' category and the said order was confirmed by the 2nd respondent vide order dated 12.04.2018. Learned counsel appearing for the petitioner, based on the averments made in the affidavit filed in support of the writ petition, submit that the deficiencies pointed out by the inspection committee have been fully complied with and as the Secretary and Correspondent of the College, was not well, could not be present before the Standing Appellate Committee along with compliance report, enclosing an affidavit, and this resulted in placing the college of the petitioner under 'no admission category'. He stated that the petitioner has filed a detailed representation on 30.04.2018 to the 1st respondent, but the same has not been considered till date.
Sri K.Ramakanth Reddy, learned Standing Counsel for respondents 1 to 3 submits that because of the deficiencies and as the petitioner has not been represented before the Standing Appellate Committee with compliance report, impugned order has been passed and the same cannot be faulted.
As per the submissions of the learned counsel for the petitioner, the petitioner - College claims to have complied with all the deficiencies pointed out by Expert Visiting Committee, but the same could not be
brought to the notice of the Standing Appellate Committee along with compliance report and necessary documents, as the representative of the college was not well on the specified date. Therefore, having regard to the facts and circumstances and in order to provide an opportunity to the petitioner, the impugned order of the 2nd respondent dated 12.04.2018, confirming the order dated 7.12.2017, is set aside and the writ petition is disposed of directing the 1st respondent to consider the representation of the petitioner dated 30.04.2018 and take appropriate decision in accordance with law.
