THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7167 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos.1 to 6 and 8 to 18 in the event of their arrest in Crime No.173 of 2022 on the file of Station House Officer, Maripeda Police Station, Mahabubabad District registered for the offences punishable under Sections 143, 147, 427, 452, 353, 436 and 506 read with Section 149 of Indian Penal Code. 2.

Heard learned counsel for the petitioners/Accused Nos.1 to 6 and 8 to 18 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case against these petitioners is that they are the relatives of the deceased girl. The deceased was married to one Bhukya Ravinder. A crime was registered against the said Bhukya Ravinder for the offences under Sections 498-A and 302 of Indian Penal Code and Section 4 of Dowry Prohibition Act for continuously harassing the deceased and ultimately hacked his wife with an axe. Enraged by the said act of murdering the deceased Bhukya

Mamatha, her family members who are the petitioners allegedly attacked the house of Bhukya Ravinder.

In view of the facts and circumstances of the case, it appears to be a case of enrage due to the death of the girl, for the said reason these petitioners can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the Accused Nos.1 to 6 and 8 to 18 shall be enlarged on bail in the event of their arrest subject to the following conditions:

i) The Accused Nos.1 to 6 and 8 to 18 are directed to surrender before the Station House Officer, Maripeda Police Station, Mahabubabad District within ten days from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.5,000/- (Rupees Five Thousand Only) each with two sureties to the like sum each, to its satisfaction. ii) The petitioners/Accused Nos.1 to 4, 8 to 10 and 12 to 18 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks and thereafter as and when required.

iii) The petitioners/Accused Nos.5, 6 and 11 shall appear before the investigating authorities as and when required. iv) The petitioners/Accused Nos.1 to 6 and 8 to 18 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
