THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.28939 of 2010 ORDER:

This writ petition was filed challenging the inaction of respondents 1 to 4 in registering the case and taking action against respondent No.5 by receiving the complaint lodged by the petitioner on 14.10.2010.

Respondent No.3 filed a counter affidavit stating that a complaint was submitted by the petitioner making some allegations against the Sub-Inspector of Police. A detailed investigation was conducted through Circle Inspector of Police, Bhadrachalam and it was revealed that the petitioner claims to be a Sarpanch of Sarapaka Gram Panchayat of Burgampadu Mandal and belongs to S.T. community. In connection with the transaction of the dealer of Ape Auto some altercation took place between one Banoth Shanker, resident of Sarapaka and the Manager of showroom. In that connection, the Manager lodged a complaint with Bhadrachalam town police station on 09.10.2010 and based on the same a case in Cr.No.135/2010 was registered. The said Banoth Shanker surrendered before the Court and was released on bail. In the said crime, the petitioner herein was an accused. A report was also submitted by the Sub Divisional Police Officer to the Superintendent of Police on 20.11.2010 for further course of action.

In view of the above facts, no relief can be granted in this writ petition, and accordingly, this Writ Petition is dismissed. No order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition

shall stand closed.
