THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.32066 OF 2013 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader appearing for respondents 1 to 5. The prayer sought for in the writ petition is as under: " to Issue appropriate writ order or direction more particularly in the nature of Writ of Mandamus by directing the Official 2nd and 3rd respondents to register a case against the 5th respondent to conduct the investigation and take action." The basic grievance of the petitioner is that in spite of giving a complaint dated 23.10.2013 to the Deputy Inspector General of Police and also the Station House Officer, Beluguppa, Anantapur District, no crime has been registered and no action is taken against the 5th respondent.

However, on the query raised by this Court with regard to the maintainability of the writ petition, the learned counsel seeks permission of this Court to withdraw the writ petition giving liberty to the petitioner to file a complaint under the provisions of Chapter-XV of the Code of Criminal Procedure. Acceding to the said request, the writ petition is dismissed as withdrawn giving liberty to the petitioner to file a private complaint under the provisions of Code of Criminal Procedure, as per law. No costs.
