Mr. Mohd.Islamuddin Ansari, learned counsel for the petitioner submits that Earnest Money Deposit of Rs.2,00,000/- was forfeited by the respondents and that he filed an application for refund of the same, as such, the cause in the writ petition does not survive for adjudication. Hence, the writ petition becomes infructuous. Recording the submission of the learned counsel for the petitioner, this writ petition is dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in this writ petition, shall stand dismissed.
