Heard both sides. With the consent of both the parties, the writ petition is disposed of at the admission stage. 2.

The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondent No.1 in not passing any order on the appeal and stay petition filed by the petitioner on 29.05.2017, as against the order passed by the second respondent, as illegal and arbitrary.

Though various grounds are raised, learned counsel for the petitioners restricts his prayer seeking a direction to respondent No.1 for disposal of the appeal filed by the petitioner, against the order dated 26.04.2016, passed by respondent No.2, at the earliest. Learned Government Pleader submits that she has no objection for the same, but a reasonable time may be granted for disposal of the appeal. 4.

Having regard to the above, the writ petition is disposed of directing respondent No.1 to dispose of the appeal filed by the petitioner against the order dated 26.04.2016, in proceedings No. C3/C5/3723/2016, dated 26.04.2017, as early as possible, preferably within a period of three (03) months from the date of receipt of a copy of the order. Till such time, there shall be interim suspension of proceedings No. C3/C5/3723/2016, dated 26.04.2017. No costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
