THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.19599 of 2012 ORDER:

This writ petition is filed seeking the following relief/s: '..to issue a Writ of Mandamus or any other appropriate writ or order or direction (i) declaring that the action of the 2nd respondent in accepting the nomination of the third respondent and in conducting the elections to the office of the President of the first respondent Association in utter violation of Rules and Regulations of the first respondent Association as arbitrary, illegal and as unjust (ii) declare that the 3rd respondent who has not functioned as a Committee Member of the 1st respondent Association is not entitled to contest for the office of the President of the 1st respondent Association as per the Rules and Regulations of the 1st respondent Association and to issue a consequently direction directing the 2nd respondent not to allow the third respondent to contest the office of the President of the 1st respondent Association and to conduct said elections strictly in accordance with the Rules and Regulations, 2012 of the 1st respondent Association, and pass such other order or order....'

[Reproduced verbatim] When the matter is taken up for hearing, the learned senior counsel appearing for the writ petitioner submits that nothing survives for adjudication in this writ petition, and, therefore, requests to dismiss the writ petition as infructuous by leaving open the questions of law. The learned counsel for the 3rd respondent submits that no question of law is involved.

In reply, the learned senior counsel submits that the question of law is in regard to interpretation of bylaws and powers of the Secretary of the Hyderabad Cricket Association and, therefore, for abundant caution such a submission is

made.

Having regard to the submissions of the learned counsel for both the sides and recording the submissions of the learned senior counsel for the writ petitioner, the Writ Petition is dismissed as infructuous leaving open the questions of law, if any, involved in this writ petition. No costs. Miscellaneous petitions, pending if any, in the writ petition shall stand closed.
