HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.26864 OF 2007 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) The petitioner has come up with the above writ petition by way of a Public Interest Litigation challenging an auction notice issued by the respondent Devasthanam.
2. Heard Sri B.S. Reddy, learned counsel for the petitioner.

In response to a call made by the respondent Devasthanam inviting religious minded and pious people to donate land and money for the purpose of construction of Kalyana Mandapams in various places, several individuals donated either money or land or both. The Devasthanam itself invested a minimum of 50% of the cost of construction to put up the construction of the marriage halls. After construction, the Devasthanam issued an advertisement in News Paper inviting tenders for the grant of licenses to private individuals, who can manage and collect the rental income or license fee from persons who take the marriage halls on license. Challenging the said notification, the petitioner has come up with the above writ petition on the ground that the
respondent cannot indulge in a commercial activity.
4. It appears from the averments contained in the affidavit that the petitioner was not even a donor. A writ petition filed for an identical prayer, by the children of two donors in W.P. No.23366 of 2007 has already been dismissed by us. When the donors themselves have no right to question the action of the respondent in conducting a public auction, third parties, like the petitioner, cannot have any grievance. The petitioner neither participated in the auction nor donated any property. It is up to the donee of a property to decide the manner in which the property can be put to better use. Therefore, the petition lacks merits and hence it is dismissed. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this writ petition, shall stand closed. __________________________ V.
