HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.32277 OF 2016 ORDER:

This writ petition is filed declaring the action of the 2nd respondent in not registering the sale transactions of the petitioner in respect of his plot bearing No.4-B in LP.No.16/2011 covered by Sy.No.370/3 part of Madhurawada Village, Visakhapatnam Rural Mandal, Visakhapatnam District basing on the letter dated 12.04.2012, as illegal and arbitrary. When the matter is taken up for hearing, it is represented by the learned counsel for the petitioner that the lis in the present writ petition is covered by the order dated 13.07.2016 in W.P.No.22077 of 2016 and the same is not disputed by the learned Assistant Government Pleader for Stamps and Registration.

For the reasons alike, this writ petition is also allowed directing the 2nd respondent to receive and process the documents presented by the petitioner in respect of his plot bearing No.4-B in LP.No.16/2011 covered by Sy.No.370/3 part of Madhurawada Village, Visakhapatnam Rural Mandal, Visakhapatnam District without reference to the letter dated 12.04.2012 issued by VUDA. In the event, the documents presented are found to fulfill the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the 2nd respondent shall complete the registration formalities and release the documents in accordance with the due procedure. It is made clear that mere registration of documents would not absolve the liability of the petitioner and his

successors-in-interest of legal action arising out of the enquiry that is stated to be pending with respondent No.3. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
