THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO W.P.No.5713 of 2015 O R D E R:
To an Order passed by the Vice Chairman & Managing Director, Andhra Pradesh State Road Transport Corporation (for short 'the Corporation') in case of a deserving and helpless woman by granting relaxation of the physical standards with regard to height, while offering employment under the 'Breadwinners Scheme' (Compassionate Appointment), the petitioner also seeks parity. It is the case of the petitioner that her husband Sri S.S. Prasad (E.No.40389), who was employed as a Conductor with the respondent Corporation at Atmakur Bus Depot, Kurnool District, died due to renal failure on 01-06-2007 after rendering nearly twenty five years of satisfactory service to the respondent Corporation.
Therefore, the petitioner also seeks the Vice Chairman & Managing Director to extend compassion even in her case by duly relaxing the physical standards, particularly, with regard to height. The learned Standing Counsel for the respondent Corporation would point out that, no where, the petitioner has disclosed as to how tall she stands as of now. Even for offering any suitable employment, the Corporation will have to necessarily make a realistic assessment as to whether necessary physical standards can be relaxed at all or not. Indiscriminate relaxation of the physical standards is likely to impair the efficiency of the Corporation itself.
I could see the force behind the objection raised by the learned Standing Counsel, particularly, in view of the fact that the petitioner is stated to be suffering from 30% visual disability of loss of vision as certified by the Ophthalmologist of the District Medical Board, Kurnool District. Further, no person can seek any relaxation as a matter of right. The circumstances of the case must warrant grant of any such relaxation. Therefore, it is for the Corporation to take a call as to these factors into consideration and decide as to whether the petitioner is suitable for employment in the Corporation or not.
Corporation take an appropriate decision for providing suitable employment to the petitioner, keeping in view the earlier orders passed by him on 13-12-2013 in case of Smt. D. Satyabhama and communicate the same to the petitioner. Let this exercise be completed as expeditiously as possible, preferably within a maximum period of two months from the date of receipt of a copy of this Order. With this, the writ petition stands disposed of at the admission stage, but however, without costs.
