CVNR, J & GSP, J C.M.A.No.476 of 2009 JUDGMENT: (Per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Civil Miscellaneous Appeal arises out of order and decree, dated 27.04.2009, in I.A.No.26 of 2009 in O.S.No.20 of 2007 on the file of the Judge, Family Court-cum-Additional District & Sessions Judge, Anantapur.

At the hearing, Sri N. Ranga Reddy, learned counsel for the appellant, submitted that as per his information, the suit, pending which the present case has been filed, itself has been dismissed for default and that therefore, the cause in the present appeal does not survive for adjudication.

In the light of the above submission of the learned counsel, the appeal is disposed of as infructuous.
