THE HONOURABLE SRI JUSTICE RAJA ELANGO CRL.P.M.P. Nos.5338 and 5339 of 2016 and CRIMINAL PETITION No.4678 of 2016 ORDER:
This Criminal Petition is filed by the petitioner-proposed accused, under Section 482 Cr.P.C., seeking to quash the proceedings against him in Crime No.108 of 2014 on the file of the Narayanpet Police Station, Mahabubnagar.
The offences alleged against the petitioner are punishable under Sections 420, 468 and 471 IPC and 66 (d) of the IT Act. When this matter has been taken up, the petitioner and the 2nd respondent, who appeared before this Court, submitted through their Counsel that due to intervention of the elders, they entered into compromise and therefore, the proceedings against the petitioner in the above case may be quashed. The 2nd respondent filed an affidavit to the effect that he has no objection to quash the proceedings in the above case against the petitioner, in view of the compromise. Both the parties have filed a joint memo also.
Learned counsel for the petitioner submitted that the proceedings against one of the proposed Accused in the above case were quashed by this Court in Crl.P. No.7845 of 2015 vide order, dated 24.08.2015, in view of the compromise and the petitioner herein also stands on the same footing and hence, the same benefit may be extended to him also.
In the above circumstances and in view of the compromise arrived at between the parties, this Court feels that it is just and proper to quash the proceedings against the petitioner. Hence, the above Crl.M.Ps. are ordered, and the proceedings against the petitioner-
proposed accused in CC No.108 of 2014 on the file of the Narayanpet Police Station, Mahabubmagar District, are hereby quashed. Accordingly, the Criminal Petition is allowed. Miscellaneous petitions pending, if any, shall stand closed. _______________ RAJA ELANGO, J April 04, 2016.
