THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1773 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.1353 of 2015 on the file of the Judicial Magistrate of First Class, Miryalaguda.

Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Section 138 of the Negotiable Instruments Act. Considering the facts and circumstances of the case and the nature of the proceedings, this Court is not inclined to interfere with the proceedings in the above C.C. At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the Court below.

In view of the request made by the learned Counsel for the petitioner, the presence of the petitioner-accused before the Court below is dispensed with, except on the dates when his presence is insisted by the Court below. It is made clear that the petitioner shall be represented before the Court below by his Counsel on all hearing dates.

With the above direction, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
