THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22970 of 2016 ORDER:

The petitioner joined the services of the Corporation in April 1987 as Conductor and his services were regularized with effect from 05.08.1987. He was promoted as Controller on 12.02.2012. While so, he was suspended from service and a charge sheet was issued by proceedings dated 28.05.2015. Challenging the said charge sheet, the petitioner filed W.P.No.20938 of 2015. He submitted his explanation on 16.06.2015. The said Writ Petition was disposed of on 10.07.2015 with a direction to complete the enquiry and pass final orders. The enquiry was completed and a final order was passed deferring annual increments for a period of two years by treating the suspension period as "not on duty". Challenging the said final order dated 24.12.2015, this Writ Petition is filed.

It is the admitted case of the petitioner that there is a right of appeal, but the learned Counsel for the petitioner submits that the time for preferring the appeal had expired and the petitioner is disabled from filing the appeal.

In the circumstances, this Court gives liberty to the petitioner to file an appeal on or before 16.08.2016 before the competent authority and it is needless to observe that if the appeal is preferred by the petitioner, the competent authority shall dispose of the same in accordance with law. While disposing of the appeal the competent authority shall not treat the appeal as delayed in view of the time granted by this Court.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
