THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26969 of 2014 ORDER:

Heard the learned counsel for petitioner, the learned Standing Counsel for respondents 1 and 2 and the learned Government Pleader for Endowments (AP) for respondent No.3.

2. The petitioner states that he was appointed as NMR Sanitary Inspector and has been working as such since 11.04.2000. He is qualified to be appointed in the post of Sanitary Inspector. It appears that the first respondent issued proceedings on 27.05.2005 requesting the second respondent to grant additional cadre strength for regularizing the services of the petitioner and other NMRs who were working in its control. The said proceedings were issued on the basis of a resolution passed by the Board of Trustees on 26.05.2005. The case of the petitioner was also recommended in the said proceedings dated 27.05.2005. The petitioner submitted a representation to the first respondent on 08.04.2011 and the first respondent forwarded the same to the second respondent, by his report dated 30.04.

2011 recommending the case of the petitioner for absorption. The petitioner further states that at one point of time, he was paid the minimum pay of scale admissible to the Sanitary Inspector, but it was restricted to Rs.10,000/- per month. He submitted a representation to the third respondent on 20.11.2011 seeking his absorption. He also submitted another representation to the first respondent on 27.09.2012 for grant of pay attached to the post. He further states that though the first respondent regularized the services of the drivers and conductors who were working on NMR basis pursuant to the directions of the second respondent, the services of the petitioner were not regularized.

2. In the circumstances, the second respondent is directed to consider the case of the petitioner based on the report submitted by the

first respondent dated 30.04.2011 and pass appropriate orders in accordance with law within a period of three months from the date of receipt of a copy of this order.
