THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.20892 OF 2016 ORDER:
This Writ Petition is filed seeking to declare the action of respondent No.4 in deleting the name of the petitioner from the revenue records in respect of the land admeasuring Ac.2-52 cents covered by Survey No.3312B situated at Muddinayanapalli Village, Kalyandurg Mandal, Anantapur District, without issuing any notice to her, as illegal and arbitrary.
The case of the petitioner is that the subject land belongs to Government and as she is in possession and enjoyment of the same, respondent No.4 - Tahsildar, Kalyandurg, entered her name in the revenue records, but respondent No.5, who is no other than her father-in-law, influenced respondent No.4 and got the subject land transferred in his name without issuing any notice to her and without conducting any enquiry. It is also the case of the petitioner that respondent No.5 was already granted D-form Patta in respect of the land admeasuring Ac.3-86 cents covered by Survey No.330-3 situated at Muddinayanapalli Village, Kalyandurg Mandal, Anantapur District. Aggrieved by the same, the present Writ Petition is filed.
Heard learned counsel for the petitioner and the learned Government Pleader for Revenue.
Learned Government Pleader for Revenue, on instructions, submits that respondent No.5 filed an appeal before respondent No.3 - Revenue Divisional Officer, Kalyandurg, for cancellation of pattadar pass book and title deed issued to the petitioner and the same was allowed by order, dated 20.05.2015. Questioning the same, petitioner has not filed any appeal or revision, but straightaway filed the present Writ Petition. In view of the above facts and circumstances of the case, I do not find any merit in this Writ Petition. Accordingly, the Writ Petition is dismissed. However, it is open for the petitioner to challenge the order, dated 20.05.2015, passed by respondent No.3.
Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs.
