THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.266 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-accused under Section 438 Cr.P.C. seeking to grant anticipatory bail in Crime No.44 of 2015 on the file of Maredumilli Police station, East Godavari District, registered for the offence punishable under Section 8 (c) r/w. 20 (b) (ii) (c) of Narcotic Drugs and Psychotropic Substances Act. Heard and perused the material available on record. It is alleged that the petitioner, along with other accused, was involved in transportation of ganja after purchasing the same from A1 to and A2. The police, while conducting the vehicle checking caught hold six persons and the petitioner fled away from the spot and the other accused stated in the confessional statements that the petitioner is in illegal possession of ganja.

Learned Counsel for the petitioner submitted that the petitioner is no way concerned with the above offence and basing on the confessional statements made by the other accused, the petitioner was arrayed as accused and A1 to A6 were already arrested and granted bail.

Learned Public Prosecutor objected for grant of bail to the petitioner.

Since there are specific allegations made against the petitioner, this Court is not inclined to grant anticipatory bail to him at this stage. Accordingly, the criminal Petition is dismissed. _______________ RAJA ELANGO, J January 19, 2016.
