Aggrieved by the proceedings No.M1/ 2(3)/ 98 MDK, dated 22-03-1999, passed by the Deport Manager of the respondent - Corporation in deferring the annual increment of the petitioner for a period of one year with cumulative effect, for causing the accident, the present writ petition is filed.

Learned counsel for the petitioner submitted that this court considering identical set of facts and circumstances in W.P.No.21453 of 2010 dated 4-10-2018 modified the punishment of deferment of one annual increment with cumulative effect to that of deferment of one annual increment without cumulative effect and monetary benefits, but with notional fixation of pay. Learned counsel seeks to similar order. Though the writ petition is of the year 2002 and underwent several adjournments, none appeared for the respondent - Corporation. Having regard to the facts and circumstances of the case and in view of order dated 4-10-2018 in W.P.No.

21453 of 2010, and for the reasons alike, the present writ petition is disposed of modifying the punishment of deferment of one annual grade increment with cumulative effect to that of deferment of one annual increment without cumulative effect, without any monetary benefits, but with notional fixation of pay. Miscellaneous petitions pending, if any, shall stand closed. No costs.
