THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.4573 of 2011 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the in action in not releasing monitory benefits by considering petitioner's representations dt.16-09-2010 and 17-012011 as illegal, unjust, contrary to law, arbitrary and also inviolation of Article 14 & 21 of Constitution of India."

Heard P. Sridhar Rao, learned counsel for the petitioner and Sri S.V. Ramana, learned Standing Counsel for A.P.S.R.T.C. for respondents, apart from perusing the material available before this Court. According to the petitioner, he retired from service on 28-02-2011 and he made representations on 16-09-2010 and 17-01-2011 requesting for release of monitory benefits due from the respondents but so far no action has been taken by the respondents. It is requested by the learned counsel for the petitioner herein to direct the respondents to take appropriate action on the said representations submitted by the petitioner herein and the said request is not opposed by the other side.

In view of the above, the writ petition is disposed of directing the respondents herein to take appropriate action on the representations dated 16-09-2010 and 17-01-2011 said to have been submitted by the petitioner herein, in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. There shall be no order as to costs.
