HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.1846 OF 2012 ORDER:

Heard learned counsel for the petitioner and the respondents. The petitioner prays for Mandamus declaring the action of 3rd and 4th respondents in deputing Collection Agents and interfering with petitioner's personal life at his residence and office at odd hours to recover loan amount without following due process of law, circular/guidelines issued by the Reserve Bank of India, is illegal and unconstitutional.

At the time of hearing, the learned counsel appearing for the respondents submits that respondents 3 and 4 have initiated steps within the four corners of law either to recover the amount due in the loan account or take possession of the mortgaged property. The allegation that respondents 3 and 4 are sending Collection Agents is denied.

Having regard to the fact that proceedings within the four corners of law are already initiated, the impugned grievance in the writ petition does not survive. I do not see any reason to interfere or grant relief to the petitioner on ipse dixit assertions.

The writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. ___________ S.V.BHATT, J Date:23.01.2015 Stp
