HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.9589 OF 2015 ORDER:

This writ petition is filed by the petitioner challenging the proceedings dated 15.01.2014, issued by the 2nd respondent-Commissioner (Appeals). It is the case of the petitioner that pursuant to the order dated 27.11.2008, passed by this Court in W.P.No.21838 of 1998, a revision filed by the petitioner was remanded back to the Commissioner of Survey Settlements and Land Records, A.P. Hyderabad-1st respondent therein, for re-consideration. Accordingly, the matter was required to be reconsidered by the said authority. By G.O.Ms.No.59 dated 21.01.1999, the Commissioner of Survey and Settlements is part Board of Revenue, was re-designated as the Commissioner (Appeals). When the matter came up for hearing on remand, the impugned proceedings were passed by the Commissioner (Appeals) by noting observation made by this Court in the order dated 27.11.2008 that the matter is required to be reconsidered by the Commissioner of Survey Settlements and Land Records.

On instructions, the learned Assistant Government Pleader for Revenue submits that this was done on mistaken impression by the Commissioner (Appeals). In the light of the said submission, the proceedings dated 15.01.2014, issued by the 2nd respondent-Commissioner (Appeals) are liable to be set aside. Accordingly, the writ petition is allowed setting aside the proceedings dated 15.01.2014, issued by the 2nd respondent-Commissioner (Appeals). However, the Commissioner (Appeals) shall hear the revision of the petitioner and dispose of the same in accordance with the law. No order as to costs.
