HON'BLE SRI JUSTICE S.V.BHATT C.R.P.No.3569 OF 2017 ORDER:

The respondent in F.C.O.P.No.118 of 2015 is the revision petitioner. The revision petitioner challenges the order of IV-Additional District Judge-cum-Judge, Family Court, Kurnool in I.A.No.191 of 2016 ordering maintenance of Rs.6,000/ - per month to respondent and also a further sum of Rs.10,000/ - towards legal expenses.

The petitioner is working as Additional Assistant Engineer in APCPDCL, Hyderabad. The learned Judge, Family Court, after taking note of all the relevant circumstances and bare minimum amount required for sustenance, granted maintenance of Rs.6,000/ - per month to respondent and Rs.10,000/ - towards legal expenses.

The counsel appearing for petitioner, though pointed out a few circumstances viz., that the respondent is in occupation of house of petitioner and has independent income, prays for reducing the maintenance amount and also legal expenses. The submissions of learned counsel even assuming to be available or probable to appreciate petitioner's case, this Court is of the view that in matters where discretion exercised by the Family Court is tenable and that discretion is not perversely exercised or the conclusions are patently illegal or erroneous, the jurisdiction of this Court under Article 227 of the Constitution of India is not exercised.

This Court is in agreement with the reasons recorded by the Court bellow.

The revision does not have merits and is, accordingly, dismissed. The learned Judge, Family Court, Kurnool considers disposing of F.C.O.P.No.118 of 2015 as expeditiously as possible, preferably within three months from the date of receipt of a copy of this order. There shall be no order as to costs. Consequently, pending miscellaneous petitions, if any, stand closed.
