ORDER

This writ petition is filed for the following relief: "to issue an appropriate writ or order or direction more particularly writ of Mandamus, declaring the investigation initiated by the second respondent as referred to, by the fourth respondent in Rc.No.475/2016-D dated 18.11.2016 as illegal, arbitrary and consequently set aside the same and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

The petitioner is the President of Proddatur Co-operative House Building Society Limited. The District Co-operative Officer, Kadapa District, vide proceedings dated 6.12.2016, ordered enquiry under Section 51 of the A.P. Co-operative Societies Act, 1964 with regard to the affairs of the society and the same is pending. Challenging the said proceedings, the Society filed a writ petition. However, vide proceedings dated 18.11.2016, the Divisional Co-operative Officer-4th respondent sought some information and the same was furnished by the petitioner on 21.11.2016. Apprehending arrest, the petitioner filed the present writ petition.

Except the said averments, no material is placed on record to show that the respondent-police are going to arrest the petitioner. The petitioner already furnished the required information on 21.11.2016 and in view of the same, no further action is needed pursuant to the proceedings dated 18.11.2016.

In the circumstances, this writ petition is disposed of directing respondents 2 and 3 to follow due process of law in the event of any crime being registered against the petitioner. No costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
