HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6692 OF 2018 ORDER:
The petitioner is A42 among several accused in Crime No.47 of 2016 on the file of the Station House Officer, Eluru Rural Police Station, West Godavari District. The crime is registered on 22.01.2016 for the offences punishable under Sections 143, 147, 148 & 302 r/w 149 IPC.

Undisputedly, the name of petitioner is one among those mentioned as the assailants. The petitioner along with A35, A40, A44, A48 and A50 moved for anticipatory bail before the learned VIII Additional District & Sessions Judge, West Godavari, Eluru in Crl.M.P.No.576 of 2018 that was ended in dismissal on 30.05.2018 by negating the contentions of there are no specific overt acts attributed against them as the F.I.R. and the case diary shows the names of petitioners in commission of the offence and they are in abscondance and the occurrence is with common object of all and they are not entitled to the concession of bail.

The petitioner even went unsuccessful along with others before this Court in Crl.P.No.15490 of 2016
Dr. SSRB,J Crl. P.No.6692 of 2018 seeking anticipatory bail that was dismissed on 08.11.2016 saying from the propensity of crime and the serious allegations not entitled to the concession of anticipatory bail.

Now, the contention of learned counsel for petitioner that investigation is almost completed and the petitioner is entitled to the concession of anticipatory bail is baseless. Hence, this Criminal Petition is dismissed as the petitioner is not entitled to the concession of anticipatory bail from the propensity of crime. _______________________________ Dr. B.
