HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.14011 of 2017 ORDER:

On 19.04.2017, this Court granted time to petitioner to amend cause title.

The petitioner through the instant prayer seeks protection of alleged possession of petitioner to an extent of Ac.388.66 cents and Ac.54.94 cents. The petitioner alternatively submits that the petitioner in his capacity as President of Adivasisena is fighting for the rights of members of Adivasisena. Even accepting without recording a finding on the inconsistent situation, the petitioner is trying to espouse, as rightly pointed out by my learned brother, the cause title should conform to the other allegations in the affidavit.

Since steps are not taken, the writ petition is dismissed. However, liberty is granted to members, who are in possession of individual extents and also the President, to file, if circumstances so warrant, fresh writ petition.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
