THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7350 of 2016 ORDER:

This Criminal Petition is filed by petitioner/A-4 under Section 438 Cr.P.C. seeking bail in Crime No.54 of 2016, on the file of Medchal Excise Station, registered for the offences punishable under Sections 8(c) and 22 of NDPS Act.

Heard and perused the material available on record. The allegations against the petitioner are that on the date of occurrence, when the police conducted vehicle checking at Medchal check post, they found A-1 and A-2 in possession of 10 kgs. of Alprazolam and arrested A-1 and A-2 and on enquiry, A-1 and A-2 disclosed that they have purchased the same from A-3 and A-4 at Kucharam Village.

Learned counsel for the petitioner submitted that the petitioner is innocent of the offences alleged against him and he is falsely implicated basing on the confessional statement of A-1 and A-2. Learned Public Prosecutor objected for grant of bail to the petitioner on the ground that even though the petitioner is added as an accused on the basis of the confessional statement of A-1 and A-2, the fact remains that the persons who gave the confession were in possession of 10 kgs. of Alprazolam and the charge sheet in the present case is not yet filed and custodial interrogation of the petitioner is necessary.

Considering the above facts and circumstances of the case, this court is not inclined to grant anticipatory bail to the petitioner at this stage.

Accordingly, the Criminal Petition is dismissed. ____________________
