THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 15576 OF 2017 O R D E R :

The grievance of the petitioner is that though the 4th respondent has been making illegal / unauthorized constructions in premises bearing No. 2-3-15 situated at Sivareddypet Village, Vikarabad Mandal & Municipality, Ranga Reddy District, Respondents 2 and 3 have not been taking any action against him. Heard learned counsel for the petitioner as well as Sri N. Praveen Kumar, learned Standing Counsel for Respondents 2 and 3.

The material placed before this Court by the petitioner discloses that the 2nd respondent had already issued the notice to the 4th respondent, invoking the provisions of Section 228(1)(2) of the Andhra Pradesh Municipalities Act, 1965 on 27.03.2017 to show cause as to why the structures raised in deviation of the sanctioned plan should not be pulled down.

Inasmuch as the 2nd respondent had already initiated action on the complaint of the petitioner by issuing the notice dated 27.03.2017 to the 4th respondent, the Writ Petition is disposed of directing the 2nd respondent to take into account and consideration the explanation, if any that may be submitted by the 4th respondent and take appropriate action in accordance with law. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
