HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT CONTEMPT CASE No. 808 OF 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.
In this contempt case, the petitioner alleges willful disobedience of the direction issued by this Court vide order dated 17.06.2013 passed in P.I.L.No.275 of 2013, whereby the 1st respondent, Principal Secretary, Municipal Administration and Urban Development Department, Hyderabad, was directed to treat a copy of writ petition as representation and consider the case made out therein and take appropriate decision in accordance with law within a period of eight weeks from the date of receipt of a certified copy of the order.
The 1st respondent has filed counter affidavit and in paragraph 6 thereof stated thus:
"It is respectfully submitted that the issue has been examined. In as such as elections for the Sarpanchs in all the Gram Panchayats were held two years back and that in the Mandal Parishad Territorial Constituencies they were held one year back, de-notifying at this stage would result in litigation, which can not be avoid. The State assures that by the next elections, the Lalpuram Village would be included in the Guntur Municipal Corporation."
From the contents of the paragraph 6 we are satisfied that the 1st respondent considered the representation and taken the decision as reflected in this paragraph. In view thereof, it cannot be stated that the 1st respondent committed willful disobedience of the direction issued by this Court. Hence, the contempt case is dismissed.
Miscellaneous petitions, if any, shall also stand dismissed.
