This Criminal Petition is filed under Section 482 of the Code of the Criminal Procedure, 1973, seeking to quash the proceedings in C.C.No.266 of 2017 on the file of XV Additional Chief Metropolitan Magistrate, Hyderabad, pursuant to the complaint dt.22.08.2017.
charge sheet came to be filed against the petitioners/A.2 to A.4 along with A.1 for the offences punishable under Sections 498-A, 406, 506 r/w. Section 34 of IPC and Sections 4 and 6 of Dowry Prohibition Act. Though the present Criminal Petition is filed seeking quashing of entire proceedings against the petitioners, learned counsel for the petitioners restricts his prayer seeking dispensation of the presence of the petitioners before the trial Court on every date of adjournment.
The learned Public Prosecutor submits that since the identity of the petitioners is not in dispute, their presence in the above C.C. may not be necessary on every date of adjournment.
Having regard to the facts and circumstances of the case, personal appearance of the petitioners/A.2 to A.4 in C.C.No.266 of 2017 on the file of XV Additional Chief Metropolitan Magistrate, Hyderabad, is hereby dispensed with
GSD, J Crl.P.No.7313 of 2019 while permitting them to mark their appearance through their counsel, except on the dates when their presence is specifically required by the said Court.
With the above direction, this Criminal Petition is disposed of.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
