THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.3227 of 2004 ORDER:

The writ petition is filed under Article 226 of the Constitution of India seeking a writ of Certiorari and quash the order dated 27.01.2003 in I.A.No.1/2003 in P.G.Case Nos.39/2003 and 95/2002, on the file of the first respondent, after calling for the records in P.G.Case Nos.39/2003 and 95/2002 and consequently to allow the I.A. directing the first respondent to decide the same on merits, after giving due opportunity to the petitioner and to pass such other necessary orders. At the time of hearing, learned counsel for the petitioner submitted that the purpose of filing the writ petition has become infructuous.

In view of the submission made by the learned counsel for the petitioner the writ petition is dismissed as infructuous. Consequently, the miscellaneous petitions if any pending in this writ petition shall stand closed.
