THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.19174 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the 3rd respondent in putting lock to the leased out premises bearing D.No.6-20-70 situated at Arundelpet, Guntur Town, Guntur District, while the application dt.11.4.2017 submitted by the petitioner before the 2nd respondent for extension of lease is pending for consideration, as being illegal, arbitrary, unconstitutional and unjust and consequently direct the respondents to extend the lease for a further period of three years."

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent No.2 herein to consider the representation, dated 11.04.2017, of the petitioner and pass appropriate orders in accordance with law. He also prayed this Court to direct respondent No.3 to forthwith remove the lock put to the shop bearing D.No.6-20-70 situated at Arundelpet, Guntur and return the furniture therein to the petitioner. 3.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.2 is hereby directed to consider the representation, dated 11.04.2017, of the petitioner and pass appropriate orders in accordance with law as expeditiously as possible, preferably, within a period of eight (8) weeks from the

date of receipt of a copy of this order. Further, respondent No.3 is directed to fix a particular date and inform the same to the petitioner and on such date, he shall open the shop in question in the presence of the petitioner and return the furniture kept in the said shop and later, he is at liberty to lock the said shop. 4.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
