HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.25112 of 2019 ORDER:
This writ petition is filed declaring the action of the respondents in demanding the petitioner to pay an amount of Rs.4,27,520/- under the guise of back billing for S.C.No.CZ002429 vide letter dated 11-09-2019 issued by the 2nd respondent as illegal and arbitrary and consequential relief of directing respondent No.5 to dispose of the petitioner's appeal dated 18-09-2019.
2. Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.

Learned counsel for the petitioner submits that against the order dated 11.09.2019, the petitioner filed an appeal before the 5th respondent on 18.09.2019 and the same is not disposed of and power connection is not restored. He submits that on the correspondence dated 16.08.2019 wherein it was shown that meter reading i.e., check reading and present reading as 50180, but all of a sudden the impugned letter dated 11.09.2019 is issued asking the petitioner to pay Rs.4,27,520/- which is illegal and without any basis.
4. On the other hand, learned Standing Counsel submits that the Writ Petition can be disposed of by directing the appellate authority to dispose of the appeal filed by the petitioner.

It is to be seen that by proceedings dated 16.08.2019 petitioner was informed about the meter reading, but in the impugned letter the meter reading is something different, that aspect has to be examined by the appellate authority and admittedly service connection was disconnected in the year 2016.

In view of the facts and circumstances of the case, the appellate authority is directed to refer the meter to the MRT (Meter Reading Test) Lab and shall test the same in the presence of the petitioner and basing on the same, the appeal shall be disposed of within 10 days from the date of receipt of a copy of this order.
7. With these observations, this Writ Petition is disposed of. No costs.
