THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND THE HON'BLE SMT. JUSTICE K.VIJAYA LAKSHMI WRIT PETITION No. 10157 OF 2017 DATED 12TH OCTOBER, 2017 Between:
M.Bharathudu ...
Petitioner AND The State of Andhra Pradesh, Rep. by its Principal Secretary, Home Department, Secretariat, Velagapudi, Amaravathi, Guntur District, A.P., and others ...
Respondents Counsel for the petitioner :
Sri P.Nagendra Reddy Counsel for the respondents :
G.P. for Services (A.P.) THE COURT MADE THE FOLLOWING
CVNR, J. & KVL, J.
wp_10157_2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed seeking enforcement of interim order dated 24-09-2014 in O.A.No. 5595 of 2014 on the file of the Andhra Pradesh Administrative Tribunal at Hyderabad.
2.
Admittedly, the remedy of contempt is available to the petitioner if the respondents have not complied with the interim order. For the reasons best known to the petitioner, he has not availed the said remedy. When this Court queried with learned counsel for the petitioner as to the reason for not availing the said remedy, he has candidly submitted that contempt case is time barred. In our opinion, a litigant cannot invoke jurisdiction of this Court for enforcement of an order having failed to avail the efficacious remedy of contempt within the period of limitation. Therefore, this Writ Petition is wholly misconceived and the same is accordingly dismissed.
3.
As a sequel to dismissal of the Writ Petition, W.P.M.P.No. 12578 of 2017 shall stand dismissed as infructuous.
