V. Rajasekhar Reddy, v. The State Of Andhra Pradesh Rep. By Its Principal Secretary,
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.22014 OF 2018 Dated:28.06.2018 Between:
V. Rajasekhar Reddy, S/o. Ramana Reddy, Aged 57 years, Assistant General Manager, Nellore District Cooperative Central Bank Limited, Nellore, SPSR Nellore District .. Petitioner And The State of Andhra Pradesh, rep., by its Principal Secretary, Department of Cooperation, Secretariat Buildings, Velagapudi, Guntur District and another .. Respondents The Court made the following:
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.22014 OF 2018 ORDER:
Heard.
2.
Petitioner is challenging the order dated 04.06.2018 imposing punishment of reversion on him. Several contentions are urged in the affidavit filed in support of the Writ Petition. 3.
Learned counsel for the petitioner sought to contend that even though detailed explanation was offered by the petitioner on more than one occasion, his explanation was not considered and straight away order impugned in the Writ Petition was passed without dealing with the explanation offered by him. He also sought to contend that the petitioner was denied of reasonable opportunity, while conducting disciplinary proceedings. 4.
A bare reading of the order impugned in the Writ Petition itself would show that no reasons were assigned in support of the decision made except referring to the explanation offered by the petitioner. It is vaguely stated that the 2nd respondent - Bank has not understood the explanation offered by the petitioner and there is no continuity. Thus, the order on the face of it is not sustainable. 5.
In view of the same, learned Standing Counsel for the 2nd respondent - Bank fairly submits that the order impugned be set aside and remitted to the 2nd respondent - Bank for consideration of the issue afresh.
6.
Having regard to the said submission, without going into the merits of the respective contentions, the Writ Petition is allowed
setting aside the order impugned and remitting the matter to the 2nd respondent - Bank to the stage of consideration of the explanation offered by the petitioner and to pass orders after considering the explanation by assigning due reasons in support of the decision. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
