HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No:25497 OF 2013 ORDER:

1. This writ petition is filed seeking to declare the action of the respondents in not considering the representation of the petitioner dated 27.8.2013 for extension of time for supplying the milled rice.

2. The 1st respondent corporation in consultation with respondents Nos.2 and 3 is supplying the paddy to the rice millers like the petitioner. For the kharif season of the year 2011-2012, 1st respondent sent 13,858.67 quintals of paddy to the petitioner-rice mill and after milling the petitioner supplied 8,458 quintals of rice to the respondents. While supplying the said stock of paddy, the petitioner requested the 1st respondent not to supply more stock as no storage godown is available. The petitioner also submitted a representation on 26.11.2012 before the respondents. The respondents without considering the same, dumped huge stocks, as a result of which, there was damage to the paddy. While so, the respondents knowing well about the factum of damage of stock extended time till 30.8.2013.

But, due to heavy rains, the petitioner could not supply the stock of milled rice. The petitioner submitted a representation with a request to grant time till 31.12.2013 to supply the stock. But the respondents are threatening that they will take coercive steps against the petitioner. Hence, the petitioner filed this writ petition.

3. When this matter has been taken up for hearing, the learned Counsel for the petitioner submitted that in connection with the subject matter of the writ petition, the Government has already passed orders vide memo No.704/CS.I-CCS/2016, dated 20.3.2017 and therefore, the respondents

may be directed to consider the representation of the petitioner dated 27.8.2013 on the basis of the above memo issued by the Government, on 20.3.2017.

4. Considering the facts and circumstances of the case and the Government Memo No.704/CS.I-CCS/2016, dated 20.3.2017, this Writ Petition is disposed of with the following direction: "The petitioner is directed to make a representation in continuation of earlier representation dated 27.8.2013, on or before 30th June, 2017 to the authorities concerned. On such representation being made, the authorities concerned are directed to consider the same in accordance with the above memo dated 20.3.2017."

No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
