THE HON'BLE THE CHIEF JUSTICE SATISH CHANDRA SHARMA AND THE HON'BLE SRI JUSTICE N. TUKARAMJI WRIT APPEAL No.1189 of 2008 JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma) Learned counsel for the appellant, at the outset, has informed this Court that the present writ appeal is arising out of the judgment delivered in W.P.No.1887 of 2001, which was dismissed based on the order of dismissal passed in other identical matters i.e., W.P.No.6287 of 2001 and batch. He has further stated that writ appeals were preferred against the judgment passed in the identical matters and the matter was remanded back to the learned Single Judge. The learned Single Judge has decided the issue afresh by an order dated 01.04.2005 in W.P.No.6287 of 2001 and batch. Against the order of the learned Single Judge, writ appeals were preferred in W.A.No.1180 of 2005 and batch and the appellants have withdrawn the writ appeals.

In the light of the aforesaid, no further orders are required to be passed in the present writ appeal and the same is accordingly disposed of.

Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
