THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8806 OF 2016 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 is filed by the petitioners/A-1, A-2, A-3 and A-5 seeking to grant bail in Crime No.49 of 2016 on the file of Adoni III Town Police Station, Kurnool District, registered for the offences punishable under Sections 468 and 506 read with 34 I.P.C. and Section 3(1)(r)(s) of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Amendment Act, 2015.

2. Heard and perused the material available on record.

3. Case of the prosecution is that A-1 and A-2 insulted and abused the de facto complainant and his wife in the name of their caste (Mala) and threatened them whereas A-3 and A-4 forged the signature of the de facto complainant and created false documents for the purpose of cheating.

4. Learned Additional Public Prosecutor opposed the bail application by submitting that there is a bar for grant of bail to the petitioners under the provisions of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Amendment Act.

5. In view of the submission of the learned Additional Public Prosecutor, this Court is of the view that this is not a fit case to grant anticipatory bail to the petitioners.

6. Accordingly, the Criminal Petition is dismissed. _________________________ JUSTICE RAJA ELANGO
