M.Vij Ay Kumar v. The State Of Andhra Pradesh
HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 22098 of 2018 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed challenging the order dated 02.02.2018 in O.A.(SR).No. 5655 of 2017 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, whereby the Tribunal held as under:
" The applicant to take steps for curing the defect as to delay, three weeks' time is given for taking steps, and in default, O.A.SR shall stand rejected automatically."
The admitted case of the petitioner is that in O.A.(SR).No. 5655 of 2017, the petitioner challenged the Proceedings Rc.C.No. 174/ PR/ 98, dated 09.12.1999 whereby he was removed from service. However, the Tribunal granted three weeks' time to the petitioner to take steps to cure the defects as to the delay. Since the petitioner has not taken any steps so far, by virtue of the order passed by the Tribunal, O.A.(SR).No. 5655 of 2017 stands rejected automatically. In view of the above, we find no ground to interfere with the impugned order of the Tribunal.
The writ petition is devoid of merit and the same is accordingly dismissed. No order as to costs. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
